Costs & Payment PoliciesA. Engagement and Travel CostsAs of June 30, 2023 we will no longer be operating from the facility at 8911 N. Capital of Texas Highway. Consequently, we have revised our mediation rates, which is explained below. We hope this will not deter you or make it difficult; our intention is to continue to provide easy scheduling with direct communication. If WE provide space, lunch, and parking: Full day rate will now include an extra fee for renting space and accommodations. We have determined a fair value for a two-party mediation is $4200; which includes 2 conference rooms, lunch, and parking. For each additional room requested, there will be an extra charge of $250. My assistant, Alyson Chaky, will be onsite to assist. If YOU provide space, lunch, and parking: The full-day mediation fee will be discounted to $3600 up to 6 parties; each additional party will be $600. To pay for your mediation, costs are usually divided between the parties but that is up to the attorneys and parties to agree upon. We only accept checks at this time. If mediation requires travel outside Austin, we bill for car mileage or airfare (depending on the location), hotel, meals, and any other out of town expenses. Travel time to and from location is billed at $200/hr. Travel within a 300-mile radius of Austin won't usually require an overnight, unless you're in a hard-to-reach location and/or your mediation is scheduled for two or more days. Half-Day Mediation Karl doesn't recommend half-day mediations, but will do them. If your dispute includes more than two parties, we won't predict you'll be able to resolve it in a half-day session. In cases like this, we encourage you to reserve a full-day session. The cost for a half-day mediation will vary depending if we have to rent space and how many parties. If we rent space for a two-party mediation, the fee is $2100. If you host, it would be discounted at $1800. This is a flat rate that includes all pre- and post mediation work but excludes lunch. A half-day to us means four hours, usually 9am-1pm or 1pm-5pm, either before lunch or after lunch. It's not our policy to travel outside Austin for half-day disputes but contact my assistant, Alyson Chaky, to discuss further. B. Booking PoliciesPlease consult our online calendar to book full-day sessions. We keep it current so you can trust that open spaces are potential dates you could reserve. To reserve a date that is open on the public calendar, please call or email Alyson as soon as you narrow down possible days and times for your attorney. As soon as you call, Alyson will either put your dates on hold or confirm them. There's an important distinction for us between a date being on hold for you and a date being confirmed for you. "On Hold" means we've penciled in a date for you, but it's not set in stone and, if you don't confirm it within a week, we will release it so someone else can have that time. Alyson understands that confirming a date requires the consent of all parties but we work primarily with the party who call to reserve a time. If you see that a date is on hold, but really want that date confirmed for your mediation, you can always ask Alyson to check with the party who has requested that date and chances are she can help you finalize your choice. There's no guarantee that any on hold date will be confirmed for you, however, until you confirm it yourself. "Confirmed" means for us that a date has been solidly reserved for a party and Karl's time and attention are unavailable for anyone else on that date. Full-Day Mediations If you need a full-day or multi-day mediation and see an open date on the calendar, you can make your reservation anytime from tomorrow to a year from now. Most people reserve one to two months in advance. But if you need a whole day, and you see an open date on the calendar tomorrow, you can book it. Half-Day Mediations If you only need a half-day session, booking works slightly differently. You'll need to check the calendar and if you see dates available between today and a week from today, you can reserve a half-day slot by calling or emailing Alyson immediately. To reserve a half-day session on a date you see available further out than one week from today, you will need to ask your attorney to call or email Karl immediately. Depending on the type of case and circumstances, Karl may choose to book half-day sessions further out than one week from today, but he won't do so without conferring directly with your attorney. FYI, emailing is likely to get you a quicker response than calling. C: CancellationsWe are willing to accept cancellations up to 24 hours ahead of your mediation. However, if your mediation is scheduled for a Monday, Alyson needs to get a call from you no later than the Thursday prior to your Monday scheduled session. If you cancel your session with less than 24 hours notice, you will be billed for the full cost of the session you reserved. Full-Day Mediation Full day rate will now include a renting space fee. PaymentPayments need to be delivered to Alyson Chaky in advance of the mediation. This means we prefer you to mail your check to Alyson before the day we get together at our office. If that proves impossible for you, and your mediation is to take place at our office, we will appreciate you handing your check to Alyson as soon as you arrive before your mediation begins. If your mediation won't take place at our office, please call or email Alyson to let her know you have mailed your check before the day we are scheduled to get together. She will note this in your file. Please DO NOT hand your check to Karl at the mediation. Karl has other things to do at the mediation. Your check could be mislaid or not recorded in a timely fashion if you hand it to Karl instead of mailing it to Alyson. Full-Day Mediation
