Arbitration Processes Can Be FrustratingHere’s Help...To begin this journey, please read what we've already told your lawyer. What's distinctive about the way Mr. Bayer does arbitration is the front-end of our workflow. Mr. Bayer encourages the attorneys to have a joint preliminary interview with him to determine whether they feel confident that his approach to arbitration will help them achieve their goals quickly, fairly, and with respect for all parties needs and concerns. Some lawyers will choose to have this kind of initial conference and some won't. If your lawyer has chosen this path, he or she may have already made an initial call to set this up. Otherwise, arbitration processes traditionally begin with a Conflicts Check and your first job is likely to be providing us with the information Mr. Bayer needs to run one. Once the parties decide to hire Mr. Bayer, you will undoubtedly be involved in helping to set up an Initial Arbitration Conference and the ball will begin rolling from there. If you will simply treat me, Ms. Chaky, as if I were a District Clerk and a Court Coordinator, your part in supporting an arbitration will be easy. Please keep in mind that arbitration is a more formal process than mediation and the protocols and procedures are formal and rule-based. I don't have as much discretion as I might in mediation and, at the same time, the parties cannot contact Mr. Bayer directly, either. Therefore, sometimes the process can seem a bit cumbersome. Please know that I understand arbitration processes can be frustrating, but I'm unable to change most things without speaking to Mr. Bayer first. If you have questions, we've provided a list of FAQs.
